Using deadly force against the police, legally–
Yep this one should really stir up the anti gun nuts–
I have mixed feelings. It might force a return to the Constitutional Requirements for search and seizure. It might encourage trigger happy cops to shoot first and ask questions latter. It might get some good police officers killed.. The law follows a court ruling that said police have the right to enter a persons home home– Even if they do so Illegally. It would be simpler to require police officers to obey the Constitutional Requirements in the Fourth and Fifth Amendments pertaining to search and seizure.. Here's the problem " ... against police officers they think are illegally entering... ".
So the local thug rationalizes to himself that when the police are yelling that they have a warrant, that he doesn't THINK they do, so he pulls his gun. The average citizen simply is not knowledgeable enough of the law to know when police are doing something legal or not. That's not an insult to the average citizen, but most have not taken courses on search and seizure law nor have then kept up with it on a constant basis. |
